Hi Phil, Mark, Steve and Nicky,
In an effort to mediate this situation that I have been caught in the middle of, I thought it would be a good idea to lay out the following and invite any further questions to be asked in the open between us all.
Does anyone disagree that MICL did receive the money that I am owed (£158,100) by RBFT before 30th June 2022.
- Nobody has ever disputed this.....
- Therefore, MICL have that money and have just refused to pay it to me for over two years.
Further to this – the following are in response to the baseless accusations that have been made by MICL and the changing reasons as to why they won’t pay me:
Does anyone disagree that Consult ZPS Ltd was delivering an EPR Change Team (via MICL) to RBFT between December 2021 and June 2022?
- In November 2021, Amanda, Nigel, Mike and James discussed and agreed that there was an ongoing requirement for an EPR Change Team and Consult ZPS Ltd was asked to assist with recruiting and managing a team of EPR / Cerner Specialists.
- RBFT can confirm that Nicholas, Abdul, Benny, Megha and James were working with their EPR Team during this time.
- There was only one Jira license – so Nicholas was managing the work for the others during this time - but each of them would be recorded in EPR CAB Minutes with actions and progress updates.
- Gary, Sarika and Marion would be able to confirm this further if needed.
- MICL approved and authorised payment of this work to Consult ZPS Ltd for December 2021, January 2022, February 2022, March 2022 and April 2022 – without question.
- All sub-contractors were paid on time by Consult ZPS Ltd.
- Invoices for the work in May 2022 and June 2022 were received without question and only when RBFT cancelled the ‘contract’ did MICL decide to retain this money and accuse me of the fact that I was not actually delivering this work.
- All sub-contractors were paid on time by Consult ZPS Ltd despite not being paid by MICL.
Does anyone disagree with the fact that I did not continue working for RBFT after 30th June 2022?
- Although I continued to have access to MICL email until 5th July 2022 – as I was completing a Cyber Essentials Accreditation on their behalf for Russells Solicitors LLP - I requested that my RBFT account be closed on 30th June 2022 and handed back my RBFT ID Badge and Laptop on 1st July 2022.
- Sean can confirm this.
- Caroline confirmed that my account had been deleted and my ID badge had not been used since 30th June 2022 in an email to me on 24th April 2023.
- The majority of the MICL team did continue to work for RBFT after 30th June 2022, and despite MICL refusing to pay them for May and June 2022 – did in fact settle with them and they all received the money that they were owed.
Does anyone disagree with the fact that Consult ZPS Ltd was asked by RBFT (with full knowledge of MICL) in 2019 to be a direct supplier to the Trust?
- As the legal case with DXC included MICL proposals and sub-contractors, Consult ZPS Ltd was asked by RBFT to be setup as a direct supplier to the Trust to pay for the extensive work that was required to collate, organise, rationalise and present in a meaningful way to enable RBFT to present their multi-million-pound case against DXC.
- Heather and Mike discussed and agreed with James and Consult ZPS Ltd was set-up as a direct supplier which, due to the volume and extent of the material that was being organised, required additional support from sub-contractors - which was requested (and agreed) by Mike and James.
- When Consult ZPS Ltd was asked to provide further temporary resources to assist with the Digital Hospital Programme (physically mapping the IT requirements within Maternity and Theatres), additional sub-contractors were paid via Consult ZPS Ltd to enable this work.
- During the time that Consult ZPS Ltd was paid directly by RBFT; an agreed rate of 1.5 days a month was invoiced to MICL for ‘admin support’.
- When this agreement ended, Consult ZPS Ltd was paid via MICL and included an additional sub-contractor resource (Maternity and Theatres) through to the end of 2020.
- During Covid and through to 30th June 2022, Consult ZPS Ltd assisted RBFT with various Projects (Cardiology, BBT and Data Flow Mapping) and being MICL’s IT Healthcare Consultant – generally supporting the account and the MICL team who were providing services to RBFT.
- In February 2022 and March 2022, in agreement with James, RBFT asked Consult ZPS Ltd for proposals to cover several Projects through to the end of 2022.
- Payment for a number of these proposals was delayed due to the replacement of the Trust Finance System in April 2022.
- I did not retain any of this money as it was planned for work after 30th June 2022.
In addition to this, MICL suggest that I was fully aware that Phil and Mark became the directors of MICL on 31st December 2021 and they were the authority (not James or Bekim) for all decisions from that date.
- My @micl.it account was removed from the ‘all MICL’ distribution list in early January 2022 (presumably at Phil and Mark's request), so any updates to me about what was happening in MICL came only from James.
- James remained the point of contact and authority on behalf of MICL for the RBFT account up until the end of May 2022.
- James presented the figures for the account (that I had collated and maintained with Carole – from MICL’s finance team) to Phil and Mark at the end of March 2022 to reassure them that the finance projections covered all of the sub-contractors until – at least – 30th June 2022. I sat across from him when he had the Zoom / Teams meeting from the TEC Canteen.
- Phil was sent all of the contract extensions for the team (including mine) which he duly signed.
- Neither Phil or Mark made any attempt to contact Heather or Mike (or Nigel) until James finally left MICL at the end of May 2022 when Phil reached out to me for the first time.
- I assisted Phil in his attempt to speak with Mike and Heather.
- I met with Phil at Royal Berkshire Hospital in early June 2022 for an introductory meeting – Phil wanted me to become an MICL employee and manage the NHS account. At no point was I asked about the EPR Project and Phil stated that he had no concerns over the finances on the account when I explained that there were delays with PO's due to the replacement finance system.
- I continued to liaise with Phil throughout June and was informed that I “…should not have been sent the Hill Dickinson legal letter….” when it was sent to all of the RBFT sub-contractors at the end of June 2022.
- On 5th July 2022, Phil called me and asked me, for the first time, about the EPR Team and what they were doing. We discussed the Hill Dickinson letter and the fact that I had seen an email recall from Carole that morning and that things were starting to be a little awkward and strained.
- It was at this point that I decided that it would be best to remove myself from MICL and take a break (as Wimbledon and the Tour de France was about to start and I had a family holiday in a few weeks) and it was left that I would get back in touch when I returned in August 2022 when things would, hopefully, have been resolved.
Here we are, nearly two and half years later…..
I assisted Phil and Mark in trying to understand the complicated nature of the account, I have assisted RBFT’s solicitors in trying to understand the complicated relationship with MICL...and I have spent thousands on legal costs trying to recover the initial money that I am owed.
So, what other questions do either of you need answering before I am paid what I am owed?
Please Reply To All - as I have nothing to hide – by the end of next week (25th October 2024) with any further questions or excuses as to why I should not be paid what I am owed.
